Please read these terms carefully
They contain important information about your legal rights and obligations when you use Fittel. By using the Fittel app or website, you agree to these terms. If you don't agree, don't use Fittel.
"Fittel" ("we", "us", "our", or the "Company") is currently operated by Ting Teck Chuan as an individual. We may transfer operation of Fittel to a successor entity (such as a registered company or a partnership) in the future; if that happens we will update this page and notify users in-app. Reach us any time at fittelbusiness@gmail.com.
Fittel is a personal-trainer ↔ client coaching app. Trainers prescribe workouts, log sessions, and review meal data; clients track sessions and meals and link to a trainer via an invite code. Some features use AI to estimate nutrition from your meal photos and to identify exercises from gym photos (see §9, Fittel Intelligence).
You must be at least 13 years old to use Fittel (16 in the EU/UK). Users under 18 should have parental or guardian consent. By creating an account you represent that you meet these requirements. Trainers using Fittel professionally are responsible for their own clients' onboarding and any consents that requires.
Fittel facilitates the connection between a trainer and a client. It does not create a coach-client legal, professional, or commercial relationship between you and your trainer or between us and either of you. Service contracts, fees, and any duty of care between trainers and clients exist outside Fittel and are solely between those parties. Fittel doesn't process payments and doesn't take a cut.
You exercise at your own risk. Stop immediately and seek medical attention if you experience pain, injury, or any symptom that concerns you. Trainers using Fittel are responsible for their own qualifications and the appropriateness of any programme they prescribe to a specific client.
When using Fittel you agree not to:
We can suspend or remove accounts that violate this section. Where the violation is serious (illegal content, harm to other users), we will act immediately.
You retain ownership of the workouts, photos, descriptions, notes, custom exercise images or videos, and other content you submit ("Your Content"). By uploading, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, transmit, and process Your Content solely to operate the Service for you (including showing it to your linked trainer/clients, generating macro estimates from your meal photos, and serving the content back to your devices). The licence ends when you delete the content or your account.
We do not use Your Content to train AI models. We do not sell your content. We do not display your content to anyone outside your trainer/client link.
Some features of Fittel use artificial intelligence and machine-learning technologies (collectively, "Fittel Intelligence") to generate nutrition estimates from your meal photos and descriptions, and to identify exercises from gym photos ("AI-Generated Content"). You acknowledge and agree that:
We expressly disclaim all liability arising from your use of or reliance on AI-Generated Content. You should always consult a qualified healthcare professional before making any health-related decisions, regardless of any AI-Generated Content you receive through Fittel.
To deliver Fittel Intelligence we transmit only the photo and any description you submit to third-party cloud hosting and AI technology providers. We do not transmit your account information, identity, HealthKit data, or your conversations with your trainer through Fittel Intelligence. See our Privacy Policy for details.
Daily insight messages shown on your dashboard are generated by simple rules from your own logged data and personal stats — they are not produced by Fittel Intelligence and your data is not transmitted to any AI provider to create them.
We're a small operation and the Service is provided "as is" and "as available." We don't promise 100% uptime, and we may modify, suspend, or discontinue any part of Fittel at any time. We may schedule maintenance without warning. We will give reasonable notice before turning the Service off entirely.
Fittel is currently free to use. If we offer paid features in the future, pricing and terms will be disclosed before purchase. Any paid subscription purchased through the Apple App Store or Google Play is governed by the applicable store's billing terms in addition to these Terms. We don't store credit-card details ourselves.
Fittel relies on third-party services that we don't control. These include third-party cloud hosting, database, object-storage, and authentication providers used to operate Fittel; Firebase Authentication and Firebase Cloud Messaging (used for sign-in and push notifications); the cloud hosting and AI technology providers that power Fittel Intelligence; Apple HealthKit and Google Health Connect (used to read your activity data only on your device); and the open-source ExerciseDB catalogue (used to load exercise images and demos). Each provider has its own terms and privacy practices; your use of features that depend on them is also governed by those terms.
You can delete your account at any time inside the app: Profile → Delete Account → confirm. This removes your domain data and your authentication identity (see our Privacy Policy for the exact cleanup behaviour, including how trainer-prescribed history is preserved on the client side).
We may suspend or terminate your account if you breach these terms or use the Service in a way that puts other users or our infrastructure at risk. Where practical we'll give notice; where the breach is serious we won't.
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, non-infringement, or availability. We don't warrant that the Service will be uninterrupted or error-free, or that AI-Generated Content will be accurate.
To the maximum extent permitted by law, we and our suppliers are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or connected with your use of the Service. Our total aggregate liability arising from your use of Fittel will not exceed the greater of (a) amounts you've paid us for the Service in the 12 months prior to the event giving rise to the claim, or (b) USD 50.
Nothing in these terms excludes liability for death, personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by applicable law.
You agree to indemnify and hold us harmless from any claims, damages, or costs (including reasonable legal fees) arising from your breach of these terms, Your Content, your conduct on the Service, or your violation of any law or third-party right.
We may update these terms from time to time. The "Last updated" date at the top reflects the latest revision. For significant changes, we'll surface a notice in-app and ask you to re-accept on next launch. Continued use of the Service after changes take effect means you accept the new terms.
These terms are governed by the laws of Malaysia, without regard to its conflict-of-law principles. Disputes arising from or connected with these terms or the Service will be subject to the exclusive jurisdiction of the courts of Malaysia, except that you may have the right to bring proceedings in your local jurisdiction where mandatory consumer protection laws give you that right.
If any part of these terms is found unenforceable, the rest stays in effect. Together with our Privacy Policy, this is the entire agreement between you and us about Fittel.
